General terms and conditions for L'Escala (Girona and others please contact):

When booking your accommodation, the following terms and conditions apply to the rental agreement made between the renter and the agency Unico Costa Brava S.L.

 

1. Payment conditions and contract:

You can book an accommodation with us by telephone or internet, after which you will receive an email confirmation. Within 7 days after receiving this confirmation you will have to pay a 40% advanced payment of the total renting costs and € 15 administration fee to Unico Costa Brava S.L., via bank transfer or credit card payment. Also, you will have to have agreed to the general terms and conditions which confirms that you have read and understood them.

Unico Costa Brava reserves the right to cancel reservations without prior notice after 7 days, if no confirmation is received from the payment of the advanced payment of 40%.

The remaining 60% of the total amount, should be paid no later than 42 days prior to your arrival date, when paid by credit card or bank transfer. If you have chosen for a cash payment, the outstanding amount must be paid on arrival. The latter is only possible if a written request (with yor reservation number, name, accommodation and arrival date) is made through info@unicocostabrava.com at the time of payment of the 40%. We remind you that this payment will only be accepted when paid in cash.

In the event that a booking is made within 42 days before the arrival date, you will have to pay the 40% deposit via a credit card payment and the remaining 60% in cash on your arrival. For other payment options, please contact Unico Costa Brava.

Unico Costa Brava reserves the right to cancel the reservation, if the entire amount of the reservation is not received at the agreed date, or if the requirements concerning the cash payment on arrival are not met. In this case you are not entitled to a refund of the amount already paid.

After having paid the advanced payment of 40% you will receive the contract for the rented accommodation, along with the general conditions, the location of the accommodation and information about how to pay the outstanding amount. The contract has to be shown upon arrival at the office of Unico Costa Brava, after which the completion of formalities will be made and the keys will be given to you.

With every reservation made, Unico Costa Brava charges a fixed amount of € 15 administration fee, that will be paid together with the advanced payment of 40% at the time of booking.

 

2. Prices and services:

The price which appears when making a reservation is the weekly price for the available accommodation and period desired by you; the cleaning price is included. The minimum stay in high season is seven nights with arrival and departure on Saturdays. For arrival/departure on another day other than Saturday during the off-season or if you are interested in a stay of less than 7 days, please contact us for information about availability and price at info@unicocostabrava.com .

In order to confirm your booking you can now proceed with the payment of the deposit of 40% of the total amount + 15 € administration fee. The remaining (60% of the total amount) should be paid no later than 42 days before your arrival, when paid by credit card or bank transfer. If you have chosen to pay the remaining amount at arrival and have informed us by sending an e-mail with your reservation number, name, accommodation and arrival date to info@unicocostabrava.com , we remind you that this payment will only be accepted when paid in cash.

The final cleaning, deposit and tourist tax has to be paid on arrival, as described below:

a)any accomodation:  a deposit of € 300 by CB (Visa-Mastercard)or cash (only).

b) The tourist tax is € 3,15 per person/per stay. Children under 16 years do not pay taxes, a parent/guardian must however sign a form, to confirm the age. Forms regarding this personal information will be provided (in your language) by Unico Costa Brava at the time of booking. The form(s) need to be completed and (latest) handed over at the check-in.

The deposit will be refunded (cash) or cancelled (CB) after an inspection of the house, done by employees of Unico Costa Brava, on an agreed date at the end of your stay; for departure without check out, the cash deposits will be refund by bank transfer.

The houses are not equipped with sheets and towels, you can either bring your own or rent them through us. In the latter case you can reserve them by contacting us before, or upon arrival (subject to availability). The price of a set of bed sheets is € 7 per person and a set of towels (1 large, 2 small) € 5 per person

Pets are accepted if the (owner of the) accommodation allows. The price is € 20 per week per pet.

Unico Costa Brava offers the possibility to rent baby cots, (on prior request and availability), for the price of € 15 per week and cot.

All extras, both compulsory (deposit) and non-compulsory (bet sheets, towels, cots etc.) must be paid in cash on arrival.

 

 3. Arrival and departure:

 The arrival time is on Saturdays between 16.00 and 19.00 o’clock. If you can not make it within this time, please get in contact with Unico Costa Brava to discuss further possibilities to collect the keys on a different day and/or time. Under no circumstances will late arrivals be accepted without prior notice. Unico Costa Brava can not guarantee the collecting of the keys on the day of arrival, when the above hours are not met or if there has been no contact about the possibility collecting them at a different time. Any additional expenses that may arise for the client (hotel stays, transportation etc.) are for the client and without exception are not recoverable through Unico Costa Brava.

If because of problems during your travel or other personal reasons, the arrival time/day can not be met and therefore your holiday stay unexpectedly shortened, Unico Costa Brava will not compensate for the lost time. If you wish to extend your stay, please contact the office of Unico Costa Brava to discuss possibilty, availibility and price.

The departure takes place no later than 10.00 o’clock on Saturday morning, at an agreed time with Unico Costa Brava. This agreement is important so that a member of Unico Costa Brava will be at the accommodation at the time you want to leave, to inspect the house and return the deposit to you. In the high-season departure may take place between 06.00 and 10.00 o’clock, in the mid and low-season between 07.30 and 10.00 o’clock.

4. Cancellation of the contract by the customer:

In the event of a cancellation the following charges will be charged:

- From the time of booking until 70 days before arrival: 10% of the total renting amount + € 15,00 administration fee.

- Between 69 and 43 days before arrival: 25% of the total renting amount + € 15,00 administration fee.

- 42 days or less before arrival: 100% of the total renting amount + € 15,00 administration fee.

A cancellation is effective from the time that Unico Costa Brava has received this in writing.

 

5. Cancellation insurance:

Unico Costa Brava strongly recommends a cancellation insurance to be financially protected in case you must cancel or suspend your journey because of unforeseen circumstances. The insurance must be taken at the same time as booking the accommodation.

Through our website you will find a page ‘insurance’ which gives you direct access to a cancellation insurance. You have to fill in the desired amount to insure (the advanced payment of 40% or the 100% total amount) after which it automatically shows you the cost of the insurance. After entering your details and you have accepted the insurance conditions you can immediately proceed to make the payment by credit card.

The insurance company , Mondial Assistance, sends you your insurance policy in the language you have chosen at the moment of closure and a copy to Unico Costa Brava.

On their web page and specifically in the insurance conditions you will be informed about the cases in which the insurance give you coverage. If any of these cases referred to applies to you, you must inform Unico Costa Brava within 3 days (72 hours) by sending a written statement which indicates the reason for cancellation (eg medical certificate, death certificate etc.) after having cancelled your booking. Accepted claims will receive the full amount what has been insured with the exception of the € 15 administration fee.

 

6. Alternatives or cancellation of the contract by Unico Costa Brava S.L.:

In the case of force majeure or a unforseen loss of the booked accommodaton, Unico Costa Brava offers a choise between replacing the accommodation with a similar accommodation (if possible) or the contract will be cancelled by returning the amount what had been paid by the renter uptil that moment.

 

7. Obligations of the renter:

The occupation of the accommodation is limited to the number of persons as stated in the contract, with children and babies counting as full persons. Unico Costa Brava may refuse access to the accommodation in case this number is exceeded.

Upon arrival at the office of Unico Costa Brava, the extra costs for cleaning and any additional costs for a baby cot, pet etc. etc. and the deposit as stated in section 2 has to be paid in cash.

The deposit will be returned at your departure in the manner and times mentioned in section 3 of this conditions. If you want to leave outside these hours, you need to inform Unico Costa Brava about your IBAN and BIC number or account number and to leave the keys in the mailbox of Unico Costa Brava. After verification of the accommodation, the amount of the paid deposit will be returned to you by bank transfer.

If the renter causes damage to the property, these costs will be deducted from the deposit. If the costs of the damages will exceed the paid deposit, the diffference has also to be paid bu the renter.

The renter is obliged to leave the accommodation in good and presentable condition. This includes (orientative, not limited to) that the dishes should be done and placed back in place, the refrigerator should no longer contain food and the bins should be emptied. If a renter does not return the accommodation in the way described above, Unico Costa Brava retains the right to deduct additional cleaning costs from the deposit.

 

8. Objections:

The renter has to respect the neighbours and rules of the community at all times. In case of negligence or inappropriate behavior, Unico Costa Brava reserves the right to terminate the contract with immediate effect and without prior notice. In this case Unico Costa Brava has no obligation to return (part of) the paid rental amount.

The pictures of the accommodations correspond with the reality, although in some cases the decorations may vary slightly. The (languages of the) available satellite channels depend on the choice of the owner.

Although Unico Costa Brava verifies each accommodation after every change of renters, it is possible that there is something wrong in the accommodation. In this case, please contact Unico Costa Brava immediately and no later than 24 hours after your arrival at the accommodation. The agency will perform the necessary work to be done as quickly as possible. The agency is not responsible for objections when we have not received a complaint about this within the specified time

 

9. Responsibilities of Unico Costa Brava:

If the rented accommodation appears to have such a serious defects that normal use of the accommodation is not possible, Unico Costa Brava will be obliged to find an alternative with similar features and price. If this is not possible due to a lack of available accommodation, a part of the paid rent will be refunded to you (depending on the time you have spent in the accommodation) without charging Unico Costa Brava any further responsibility.

Unico Costa Brava will not be responsible for the following cases:

1.-Negligence or failure of services by third parties.

2.- Malfunction or incorrect operation of community pools, playgrounds and sports facilities of any kind of which responsibility is for the user.

3.- Theft in the accommodation.

4.- Damage to persons or accomodation caused by an act of God, unforseen circumstances or natural causes such as weather, where Unico Costa Brava can not react.

 

10. Validity and being entitled:

When booking an accommodation the above conditions apply.

Both these general conditions as the rental contract between you and Unico Costa Brava are applied and controlled to the Spanish law according to the court in Figueres (Girona) Spain.
